East Herkimer Volunteer Fire Department No. 1, Inc. would be exempt from the 45% limit on nonresident members. Nonresidents here means members living outside both the department’s designated territory and areas it protects under contract. Nonresident volunteers would need to remain available for active service because of where they live or usually work. Town board approval and department membership rules would still apply. The exemption would take effect immediately if the bill becomes law.
