New Berlin’s law allows the village to sell about 7.54 acres for a nursing and rehabilitation facility, with money directed to local parks and any required federal steps completed first.
New Berlin’s law allows the village to sell about 7.54 acres of parkland to Good Shepherd Communities for a nursing and rehabilitation facility, if the village directs at least the land’s fair market value to local parks or recreation facilities.
The village may stop using the described land as parkland and sell it to Good Shepherd Communities at fair market value. The authorization covers about 7.54 acres in the Village of New Berlin and allows a sale to Good Shepherd Communities for a skilled nursing and rehabilitation facility. The village must dedicate at least the land’s fair market value to buying new parkland or improving existing parks or recreation facilities in the village. If the village received federal support to buy, maintain, or improve the land, it must first meet federal requirements for changing the land’s use. Those requirements may include providing replacement land of equal fair market value and usefulness. The law takes effect immediately. If the village received federal support for the land, the sale and change of use must wait until it meets applicable federal requirements.
