Niagara may sell about 5.1 acres to David Gaines for residential improvements, if the town directs at least the land’s fair value toward parks or recreation facilities.
The law authorizes Niagara’s governing body to stop using the land as parkland and sell and convey property interests in it to David Gaines. The authorization covers about 5.1 acres in the Town of Niagara, Niagara County, for sale at fair market value for residential improvements. The town must direct at least the land’s fair market value toward acquiring parkland or improving existing parks and recreation facilities. If the town received federal support to buy, maintain, or improve the land, it must first meet federal requirements for converting parkland. This includes satisfying the U.S. interior secretary that replacement land will have equivalent fair value and usefulness, if required. The law took effect immediately. If the town received federal support for the land, it must meet applicable federal requirements before ending park use or transferring it.
