Starting September 9, 2027, New Jersey public works contractors must prove experienced trade workers meet qualification rules, with exemptions for union members under certain employer agreements.
Starting September 9, 2027, public works contractors must document that experienced trade workers meet apprenticeship or four-year work-history requirements. Union members covered by certain employer agreements are exempt.
Contractors must submit a state certification form and supporting records showing that each covered worker meets the qualification rules. The requirement covers journeypersons, meaning experienced trade workers, employed by contractors on New Jersey public works jobs. Workers qualify through a registered apprenticeship in their trade with standards equivalent to a U.S. Department of Labor program, plus active employment in that trade. Alternatively, workers qualify through four years of trade work verified by pay records or sworn statements from the worker and the employers involved. Union members are exempt if their employer has a union agreement used now or previously to set the state’s required public works pay rate. Union members are also exempt if their employer has an agreement with a labor organization recognized under federal law that provides for jointly managed labor-management benefit funds. The law takes effect one year after enactment, on September 9, 2027.
