Starting August 18, 2026, employers that authorize sharing their self-funded plans' claims data in writing can access yearly reports on plan use that do not identify people.
The insurance commissioner must give eligible employers access to a yearly report on how their health plans are used. This covers employers sponsoring self-funded health plans. An employer must authorize submission of its plan's claims data in writing. The report must combine claims data and leave out information that identifies people. Employers do not have to submit the data themselves. The requirement takes effect August 18, 2026.
