The proposal would limit local bans on many working animals while leaving local governments able to set rules for animal care, public health, and public safety.
Local governments could not ban many animals used for work or make their use unreasonably difficult. They could still set animal care, health, safety, and zoning rules.
The proposal would bar local governments from passing rules that ban or effectively ban covered working animals or create an undue hardship for their use. It would apply to cities, counties, towns, villages, and other listed local governments. Covered animals are used for specific duties in commerce or an animal enterprise, including service, transportation, law enforcement, education, competition, or exhibition. It excludes poultry, swine, dairy and beef cattle, sheep, goats, and similar animals raised for production. Local governments could still make rules about animal care, public health, and public safety. The proposal would not change state rules on animal care, public health, or public safety. It would not override local zoning rules under Title 7, chapter 1.
