Certain arresting agencies would pay actual holding costs plus 10%; counties would pay costs in specified local and probation cases; and the state corrections and health departments would pay actual costs plus 10% in listed cases. This covers people held in detention centers by an arresting agency that does not operate the center, city or town commitments to county centers, probation violators, sentenced defendants, and people awaiting placement in an appropriate health facility. The arresting agency and detention-center operator may agree to different payment terms. The county payment rules have an exception under section 7-32-2245. The Department of Public Health and Human Services payment applies when a person is committed to the department director's custody and is awaiting placement under the listed statutes. Payments apply while the person is held; the corrections department's responsibility begins after sentencing, and the health department's responsibility applies while the person awaits placement.
