Montana would stop using state and available federal money for certain opioid reversal drug purchases, while allowing some existing supply promises to continue.
Starting July 1, 2025, Montana could not use state or available federal money to buy opioid reversal drugs from companies tied to certain state opioid settlements. Some existing contracts and settlement supply promises could continue until their terms are fulfilled, but covered state contracts could not be renewed after June 30, 2025.
The proposal would bar state agencies from using state or available federal money to buy opioid reversal drugs from certain companies. It would cover companies that were party to a state settlement over making, selling, or distributing prescription opioids, and their affiliates and subsidiaries. The restriction would not apply to a supplier with a state contract signed before July 1, 2025, until that contract's terms are fulfilled. A covered state contract could not be renewed after June 30, 2025. A supplier that agreed to provide the state with these drugs under a settlement made before September 1, 2024, would have to keep supplying them until the settlement terms are fulfilled. The proposal says it would take effect upon passage and approval. The purchase restriction would apply after June 30, 2025.
