What it does
After placing the person in the county jail, an Idaho county sheriff’s office may seek repayment from the agency identified in court records. The Idaho Department of Correction must budget for these expenses each year and ensure payment within 30 days of receiving an invoice.
Argument forSheriff’s offices could recover reasonable costs of returning people who abscond from Idaho supervision, including travel and staff expenses.
Argument againstPaying sheriff’s offices for reasonable return costs could leave the Idaho Department of Correction with less money for other needs.
More detail
A county sheriff’s office may seek repayment for reasonable costs of returning an absconder to Idaho custody. This applies to Idaho county sheriff’s offices collecting people who absconded from Idaho Department of Correction supervision. The office must spend money from its budget to travel to another state and collect a prisoner, probationer, or parolee who absconded from Idaho Department of Correction supervision. The person must be placed in the county jail before the office seeks repayment. The office must send an invoice for reasonable return costs to the agency identified in court records as the agency from which the person absconded. The law takes effect July 1, 2026. The 30-day payment period begins when the Idaho Department of Correction receives an invoice.
