Starting in 2027, the state transfers 5% of certain tax revenue from electric power distribution to the air pollution account. The department may use it for air pollution control only after lawmakers approve spending.
A licensed dealer may sell a covered vehicle before inspection, but must tell buyers about their return option. Buyers who meet the time and mileage limits may return a vehicle that fails inspection for repair and approval.
Owners and operators of cotton gins that are not class A sources do not have to submit air dispersion modeling to get a construction permit.
Starting July 1, 2027, excess unspent balances in the Natural Resources Protection Fund stay in the fund instead of returning to general revenue.
The state treasurer transfers 5% of certain sales and use tax revenue to the air pollution permit fees account. The transfer is based on state sales and use tax revenue from electric power distribution in the preceding calendar year. The department may use the transferred money only for the air pollution control program, and only after the General Assembly appropriates it. Beginning July 1, 2027, the commissioner estimates the prior calendar year's tax revenue each July 1, and the treasurer transfers the specified share.
A licensed vehicle dealer may choose to sell a covered vehicle with or without an emissions inspection before sale. These options apply to vehicles subject to the state emissions inspection program when sold by a licensed motor vehicle dealer. With prior approval, the dealer must disclose in writing whether the vehicle met emissions standards or received a waiver. Without prior approval, a buyer may return a failing vehicle within ten days if it has no more than 1,000 additional miles; the dealer must then repair it and provide approval within five working days, unless both sides agree otherwise. For a sale with prior approval, the inspection must be within the 120 days before sale. The buyer's return option lasts ten days after purchase.
An owner or operator of a cotton gin that is not a class A source need not submit air dispersion modeling to obtain a construction permit. This applies only to a cotton gin that is not a class A source.
Unspent balances in the Natural Resources Protection Fund subaccounts above the prior biennium's collections do not revert to the state's general revenue fund. The rule applies to unspent balances in the fund's subaccounts that exceed collections from the preceding biennium. This rule begins July 1, 2027. Before June 30, 2027, excess balances revert to general revenue at the end of each biennium.
