Maryland removes the prior tax-filing requirement for lower public college tuition for students, including undocumented students, who meet the remaining eligibility rules.
Students, including undocumented students, no longer need a prior Maryland tax-filing history to initially qualify for lower public college tuition. Other school, enrollment, and residency requirements still apply.
Maryland removes the prior tax-filing requirement for initially qualifying for an exemption from higher out-of-state tuition. The exemption covers eligible students at Maryland public colleges, including undocumented students. It excludes people with temporary nonimmigrant status. Students must have attended a Maryland high school and graduated from a Maryland high school or earned an equivalent diploma in Maryland. Students without permanent resident status must promise to apply within 30 days of becoming eligible. Those required to register for Selective Service must show they have registered. To keep the lower tuition rate until earning a degree, students must still show Maryland residency each year through a Maryland tax-return address or other official documents accepted by their college. The law took effect July 1, 2026. Students must enter a Maryland public college no later than six years after graduating from high school or earning an equivalent diploma.
