Louisiana law lets local railroad owners buy used rail equipment
Louisiana law lets local governments that own or operate railroads buy used or rebuilt rail equipment without following this section’s public purchasing rules.
1
What it does
Local governments that own or operate railroads may buy used or other non-new rail equipment and related parts without following this section’s public purchasing rules for those purchases.
Argument forThe exemption may give local railroad owners more choices when they buy used equipment or parts for their rail lines.
Argument againstThe exemption could make it harder to compare competing offers when local governments buy used rail equipment.
More detail
The law exempts certain rail equipment purchases from this section’s public purchasing rules. The exemption covers locomotives, on-track equipment, other rail vehicles, and track maintenance equipment, along with their parts or attachments where listed. The buyer must be a political subdivision that owns or operates a railroad or railway. The equipment must be used or otherwise not in new condition; this includes rebuilt, reconditioned, or reclaimed products.
