Courts would exclude certain firefighter pay increases from former spouses’ shares
Louisiana courts would exclude certain full-time firefighter pay increases from a former spouse’s community-property share once the Act takes effect.
1
What it does
A former spouse’s community-property share would not include a full-time firefighter’s later pay increase tied to passing a written exam and work test.
Argument forFirefighters could keep more of pay increases earned through later testing, rather than sharing those increases with a former spouse.
Argument againstFormer spouses could receive a smaller community-property share because these qualifying pay increases would be excluded from the calculation.
More detail
Courts would leave certain firefighter pay increases out of a former spouse’s community-property share. The rule covers a full-time firefighter’s pay increase that follows the end of the marriage’s community-property regime and depends on passing both a written examination and a work test. The pay increase must be conditioned on passing both tests. The rule applies despite other laws that might otherwise provide a different result. The Act would take effect when signed, when the time for becoming law without the Governor’s signature expires, or the day after legislative approval following a veto.
