If a related law takes effect, Louisiana’s board will review selected drug prices, and manufacturers will report prices and certain large increases beginning January 1, 2027.
A state board reviews selected drug prices, reports on drugs it finds excessively costly, and may recommend ways to lower costs while preserving access to care. These rules take effect only if a related law takes effect.
For up to 10 selected drugs, manufacturers report price increases, company research and development spending, and reasons for price changes; the board publishes a yearly report. These rules depend on a related law taking effect.
Manufacturers report current drug prices each year. For certain large increases in drugs costing at least $100 for a 30-day supply, they report the reasons and other company details; the state publishes price information online. These rules depend on a related law taking effect.
The Prescription Drug Affordability Board reviews selected drug prices and reports its findings to lawmakers and the public. The board is within the Louisiana Department of Insurance and includes state officials and appointed public members with significant health or pharmacy experience. The board may recommend ways to lower costs while maintaining access to and the quality of care. These provisions take effect only if Section 7 of Senate Bill 387 of 2026 is enacted and becomes effective. The board reviews its critical drug list at least once every three years and reports to lawmakers each year, at least 60 days before the regular session begins.
Manufacturers report price and company information to the board, which publishes annual reports. The board selects up to 10 drugs each year on which Louisiana spends significant health care dollars after counting rebates. The board selects drugs from different drug classes and may include generic drugs. The information manufacturers submit under this reporting duty is exempt from public inspection and copying. These provisions take effect only if Section 7 of Senate Bill 387 of 2026 is enacted and becomes effective. The board identifies drugs by June 1 and publishes its report by December 31 each year.
Manufacturers report current drug prices and certain large price increases to the state, which publishes price information online. The annual price report covers FDA-approved prescription drugs the manufacturer sells in or into Louisiana. Extra reports include the increase’s causes; annual reports also include company research costs and names of recently approved drugs and drugs that recently lost patent exclusivity. Extra reporting applies when a drug that cost at least $100 for a 30-day supply before the increase rises by at least 40% over the prior three calendar years or at least 15% in the prior calendar year. A manufacturer that corrects a deficient report within 45 days after notice cannot be fined for that reporting failure. The Department may assess penalties of up to $1,000 per day for each violation. These provisions take effect only if Section 7 of Senate Bill 387 of 2026 is enacted and becomes effective. Current price information is due by January 15 each year. A report about a covered increase is due within 30 days after it takes effect, and the state publishes increase information within 60 days of receiving the report.
