Local governments may restrict vapor product sales near schools
Louisiana law lets municipalities and parishes bar licensed sellers from selling, offering, or storing vapor products within 300 feet of a school if they adopt an ordinance.
1
What it does
A municipality or parish may bar licensed sellers from selling, offering, or storing vapor products within 300 feet of a school, but only after adopting an ordinance. The rule excludes certain state-authorized, state-regulated marijuana products.
Argument forLocal governments could keep vapor products farther from schools by barring sales, offers for sale, and stored stock within 300 feet.
Argument againstSellers could face different distance rules across communities, and a straight-line measurement would apply only to new permits issued after its adoption.
More detail
A municipality or parish may adopt an ordinance barring the sale, offer for sale, or storage of vapor products at licensed premises within 300 feet of a school. It covers licensed premises within 300 feet of a school as defined by state law. In municipalities and qualifying unincorporated areas, the distance is measured along sidewalks unless an alternate method is adopted. The restriction applies only after the municipality or parish adopts an ordinance. It does not apply to lawful marijuana or marijuana products authorized under state law and regulated by the Louisiana Department of Health. If a municipality or parish adopts an alternate straight-line measurement, it applies only to new permits issued on or after that ordinance is adopted.
