Starting in the 2027–2028 academic year, public colleges could not require covered students to live in student housing, pay a fee for living elsewhere, or sign a housing agreement to enroll or take part in college programs or services.
A public college or university could not require a covered student to live in student housing, pay a fee for living elsewhere, or sign a housing agreement as a condition of admission or participation. It would cover students at public postsecondary institutions who are at least 17 years and 6 months old on the first day of a semester, except for the stated exemptions. Student housing is a facility the institution owns, leases, contracts for, occupies, or operates to house its students. This rule would not apply to residential dual enrollment programs or the model and practice school. It would also not apply to a student who is 17 years and 6 months old or younger on the semester’s first day if the student’s parent or guardian has not given written consent for the student to live outside student housing. The rule would begin with the 2027–2028 academic year.
