Hawaii allows major repairs at state parks and boat harbors
Since July 1, 2026, Hawaii’s land department may authorize major repairs at state harbors and parks without prior approval, while giving lawmakers advance notice and regular reports.
1
What it does
The Department of Land and Natural Resources may carry out major repairs, renovations, or replacements at state small boat harbors and parks without approval from the Legislature or Governor.
Before authorizing covered project spending, the department must give the Legislature written notice at least fourteen business days ahead.
Twice a year, the department must report covered spending, completed work, reasons for each expenditure, project status, and a detailed accounting of capital improvement projects.
Argument forHarbor and park managers may be able to address major repairs sooner because qualifying work can proceed without prior approval from the Legislature or Governor.
Argument againstLawmakers could have less control over major harbor and park repair spending because these projects can proceed without their approval, after advance notice.
More detail
The Department of Land and Natural Resources may carry out qualifying projects without approval from the Legislature or Governor. This applies to capital improvement projects at state small boat harbors and state parks. Projects must repair, renovate, or replace existing facilities, including through dredging, and be limited to major work. The funds cannot be used to build new facilities or related structures. This law took effect July 1, 2026, and is repealed five years after that date.
A department managing a covered expenditure must notify the Legislature in writing before authorizing it. The notice applies to expenditures for projects allowed under the harbor and park exception. Notice is due no later than fourteen business days before the department authorizes the expenditure.
The Department of Land and Natural Resources must report to the Legislature twice a year. The reports include expenditures under the harbor and park exception and a detailed accounting of all capital improvement projects. Reports must cover covered spending, completed work, reasons for each expenditure, project status, and a detailed accounting of all capital improvement projects. Reports are due by June 30 and December 31 each year while this law is in effect.
