Hawaii requires approved materials and review fees for land plans
Hawaii's law requires approved physical materials for filed land plans and requires landowners to deposit survey review fees before approval.
1
What it does
Land plans must use good-quality physical materials approved by Hawaii's Department of Accounting and General Services. Parcels on one plan must touch unless the agency approves an exception.
Landowners must deposit the cost of reviewing their survey and plan before approval. The Department of Accounting and General Services sets the fee through its rules.
When original land plans or maps cannot produce satisfactory copies, state staff must make certified replacements on good-quality physical material. Those replacements count as originals.
Argument forAllowing approved physical materials for land plans could help surveyors use practical materials while keeping state quality standards.
Argument againstFees set through agency rules could make landowners' survey review costs harder to predict without checking the current fee rules.
More detail
The Department of Accounting and General Services approves the physical material used for land plans. These rules cover land plans filed for registration. Parcels on one plan must touch unless the agency approves an exception. Plans must use a listed size and drawing scale. Land being removed from the land registration system cannot be split or combined when registered as a filed plan. The law took effect upon approval.
The Department of Accounting and General Services charges a survey review fee set through its rules. The fee covers checking a land survey and plan for proper form and correct math. The landowner must deposit the review cost before the survey and plan are approved. The law took effect upon approval.
The Department of Accounting and General Services makes, certifies, and files replacement copies on good-quality physical material. This process covers filed plans and land court maps held by the Bureau of Conveyances, Hawaii's land records office. The registrar must send the plan or map to the agency when the original's condition prevents satisfactory copies. The law took effect upon approval.
