Hawaii corporation may acquire eligible land for agriculture
Hawaii’s Agribusiness Development Corporation may acquire eligible land for farming or irrigation through condemnation, subject to limits, under a law that took effect July 1, 2026.
1
What it does
Hawaii’s Agribusiness Development Corporation may use condemnation to acquire eligible land for farming or irrigation. Public lands and property in certain counties are excluded.
Argument forThe authority could help the corporation assemble land for farms or irrigation when it determines the property is needed for those purposes.
Argument againstThe corporation’s authority could put pressure on eligible landowners, even though private property sought under threat of taking must be acquired through negotiation.
More detail
The Agribusiness Development Corporation may acquire eligible real property or an interest in it through condemnation, a legal process for taking property for public use. The authority covers real property, including fixtures and improvements, or an interest in real property, subject to the stated exclusions. The corporation must determine that the property is needed for its immediate or future use for agricultural irrigation systems or agricultural purposes. The authority excludes public lands and property in a county with more than 125,000 but fewer than 195,000 people. Private property sought under threat of eminent domain may be acquired only through negotiated purchase. The law took effect July 1, 2026.
