Hawaii checks registry before hiring or approving student-facing volunteers
Hawaii’s education department checks a registry before considering job candidates or approving certain volunteers, and contractors and volunteers are covered only in roles involving student interaction.
1
What it does
The Department of Education keeps a registry of employees found to have harmed students. Contractors and volunteers are covered only when their roles involve student interaction; people enrolled at the institution when employed are exempt.
Before considering a job candidate or approving a volunteer for a role involving students, the Department of Education must check the registry. A listed person cannot be considered for the job or serve in that volunteer role.
Argument forChecking the registry could help the Department of Education keep people listed for harming students out of covered jobs and volunteer roles.
Argument againstA listed person could lose a chance at a Department of Education job or volunteer role involving students, even when the listing affects future opportunities.
More detail
The Department of Education maintains a registry of employees found to have harmed students. The registry covers employees of public and private institutions serving students in early learning programs or kindergarten through grade 12. Contractors and volunteers are covered only when their roles involve interaction with a student. A person enrolled as a student at the institution when employed is exempt. Before sending a person's information, the institution must certify that the person received written notice and an opportunity to appeal, and either waived the appeal or lost it. The investigation must let the complaining and accused parties provide information and support its finding by more likely than not evidence. The Act took effect upon approval on June 24, 2026.
The Department of Education checks the registry when considering job candidates and approving certain volunteer roles. The department must check candidates for employment and volunteers whose roles involve interaction with, or close proximity to, students. If a candidate or potential volunteer is listed, the department must stop considering the candidate for employment or prohibit the volunteer from the covered role. The Act took effect upon approval on June 24, 2026.
