Hawaii allows meeting payments for regional burial council members
Hawaii's law allows meeting payments for regional burial council members and requires a majority of appointed members, with at least three present, to conduct business.
1
What it does
Island burial council members who represent geographic regions may receive daily meeting payments from the Office of Hawaiian Affairs. Its trustees decide the amount and eligibility rules.
Each island burial council needs a majority of its appointed members present to conduct business. At least three members must attend, even when seats are vacant.
State agencies must submit candidate lists within 75 calendar days when a burial council seat becomes vacant during a member's term. Exceptions apply; this is not an appointment deadline.
Argument forMeeting payments could help regional representatives afford to serve, making it easier for burial councils to recruit and keep members.
Argument againstCounting appointed members could allow a small group to act on burial matters while vacant seats leave some communities without representatives.
More detail
The Office of Hawaiian Affairs may pay eligible regional council members for attending meetings. This payment provision covers island burial council members appointed to represent geographic regions. The Office of Hawaiian Affairs board of trustees sets the payment amount, process, and eligibility rules. Payment is allowed for each day a member attends a meeting announced through the required public notice. The law took effect upon approval on June 5, 2026.
Island burial councils need a majority of their appointed members present to conduct business, with at least three members present. The attendance requirement applies to each island burial council and counts appointed members. A council action also needs agreement from a majority of the members present. The law took effect upon approval on June 5, 2026.
The Department of Land and Natural Resources and the Office of Hawaiian Affairs must submit candidate lists within 75 calendar days of a midterm vacancy. This deadline covers seats that become vacant during an island burial council member's term. The deadline has exceptions under subsection (c). The law took effect upon approval on June 5, 2026. The 75-day period starts when the vacancy occurs.
