Hawaii funeral providers must dispose of human remains within 60 days
Cemeteries and funeral service providers must dispose of human remains within 60 days of the later permit event.
1
What it does
Cemeteries and funeral service providers must dispose of human remains within 60 days of the later permit event. The state health department need not put the specific date on the permit.
Argument forFamilies may have less uncertainty about when providers must handle remains because the law sets a 60-day deadline tied to permit paperwork.
Argument againstA firm 60-day deadline could leave providers less flexibility when permit paperwork takes longer than expected.
More detail
Cemeteries, crematories, funeral establishments, hydrolysis facilities, and mortuaries must dispose of human remains within the stated period. This applies to cemeteries, crematories, funeral establishments, hydrolysis facilities, and mortuaries handling a dead human body. The Department of Health does not have to put the specific disposition date on the permit. The department may adopt rules for this section. The 60-day period runs from the later of the burial-transit permit issue date or the date an affidavit to amend the permit is submitted.
