Hawaii agencies must post policies for immigration enforcement requests
Hawaii agencies must post facility policies by January 1, 2027, covering warrant checks, staff training, and notices that services are available regardless of immigration status.
1
What it does
State and county agencies must post policies for facilities they operate. The policies must cover warrant checks, staff training, and notices that services are available regardless of immigration status.
The attorney general must publish model policies for state and county agencies. Private education and health providers, and places of worship, may choose to adopt them.
Argument forClear warrant procedures and notices may help people feel safer seeking services, regardless of immigration status.
Argument againstAnnual training and warrant procedures could take staff time that agencies might otherwise use to provide services.
More detail
State and county agencies must adopt and post written policies for facilities they operate. The requirement covers state and county agencies operating any facility run by the State or a county. A nonpublic area is any part of a facility not open to the general public. Policies must identify areas closed to the public, set warrant-check and staff-response procedures, bar collecting immigration-status data unless the law requires it, require annual staff training, and require multilingual notices that services are available regardless of immigration status. The law does not restrict the University of Hawaii from meeting required federal contractor certifications or other conditions tied to federal funding. Agencies must adopt and post the policies by January 1, 2027. The law took effect upon approval.
The attorney general must publish model policies. The model policies are for state and county agencies operating protected community locations and for voluntary adoption by private education or health providers and private places of worship. Private education and health providers, and private places of worship, may choose to adopt the model policies; adoption is voluntary for them.
