Court clerks send servicemember case orders to military security forces
For protective order cases involving an alleged servicemember, Hawaii law requires court clerks to notify county, state, and designated military security forces.
1
What it does
When a protective order case involves a respondent alleged to be a servicemember, the court clerk sends the order to county police, state law enforcement, and designated military security forces.
State and county justice agencies set communication and training procedures with military security forces, including which forces receive notices.
Argument forQuick notice could help military security forces respond when a protective order involves an alleged servicemember, which may help prevent further harm.
Argument againstSharing protective order information with military security forces could expose sensitive details, so careful procedures may be needed to protect privacy and due process.
More detail
Court clerks send protective orders to county police, the Department of Law Enforcement, and designated military security forces. The order must be issued under the law covering protective orders. This applies when the respondent is alleged to be a servicemember. The clerk must send the order within 24 hours.
The Judiciary, county police departments, and the Department of Law Enforcement establish communication and training procedures in consultation with military security forces. The procedures cover communications and training for carrying out the protective order notice requirements. The procedures include identifying which military security force receives notices.
