Eligible farm kitchens follow home-kitchen rules for homemade food
Hawaii farm kitchens that meet home-kitchen standards cannot be required to obtain a commercial food permit solely because they sit on agricultural land.
1
What it does
Farm kitchens that meet home-kitchen rules receive the same treatment. Their location on agricultural land alone cannot trigger a commercial food permit, but food safety rules and inspections still apply.
The Department of Health must adopt rules for farm kitchens under this law. It keeps authority to restrict or ban preparation of higher-risk foods.
Argument forEligible farm food producers could avoid commercial permits based only on their location, making their permit requirements clearer.
Argument againstHome-kitchen sales limits and product restrictions could limit what farm producers sell, even when their kitchens meet food safety standards.
More detail
Hawaii’s Department of Health must regulate eligible farm kitchens in the same way as home kitchens. Covered kitchens prepare homemade food on agricultural land, including land zoned for farming or actively used for farming. Ingredients need not come from the same farm. Farm kitchens must meet home-kitchen requirements, including food safety, labeling, sales limits, and limits on allowed products. A commercial food establishment permit cannot be required solely because the kitchen is on agricultural land. The Department of Health retains its power to inspect kitchens and enforce food rules. The law took effect upon approval on June 8, 2026.
Hawaii’s Department of Health must adopt rules needed to carry out the law. The rules cover farm kitchens preparing homemade food products under the same standards as home kitchens. The Department of Health can restrict or ban preparation of foods that its rules identify as posing higher risks to public health. The rulemaking duty began when the law was approved on June 8, 2026. The law sets no deadline for adopting rules.
