Starting in 2027, Florida kiosk businesses must register, limit daily transactions, give customers receipts, and refund some first transactions tied to fraud.
Kiosk businesses must register before operating in Florida. Businesses operating on or before January 1, 2027, must apply within 30 days; licensed money transmitters are exempt from this registration.
New customers may transact up to $2,000 per day, and existing customers up to $10,000, across one or more kiosks. Kiosks must also show a fraud warning and offer a receipt with transaction and fee details.
A kiosk business must fully refund a customer’s first transaction within 72 hours if the customer reports the alleged fraud to the business and a government or law enforcement agency within 60 days, and provides proof.
Virtual-currency kiosk businesses must register with Florida’s Office of Financial Regulation before operating. The rule covers businesses offering virtual-currency kiosk services in Florida. Businesses operating on or before January 1, 2027, must apply within 30 days after that date. A money transmitter licensed as a money services business is exempt from kiosk-business registration, but must follow the customer rules for disclosures, transaction limits, receipts, and refunds. The registration requirement takes effect March 1, 2027. Existing businesses must apply within 30 days after January 1, 2027.
Kiosk businesses must check daily totals, display a fraud warning, cap transactions, and provide a detailed receipt. These rules apply to virtual-currency kiosk businesses and their customers in Florida, including licensed money transmitters exempt from kiosk-business registration. Before a transaction, kiosks must ask whether the customer used another kiosk that day and how much the customer transacted. A new customer has used a kiosk for fewer than 7 days; an existing customer has used one for 7 or more days. These requirements take effect January 1, 2027.
A kiosk business must fully refund a customer’s first virtual-currency transaction within 72 hours when the stated fraud conditions are met. This applies to a customer’s first virtual-currency transaction with a kiosk business. The customer must notify the kiosk business and a law enforcement or government agency within 60 days, and provide proof of the alleged fraud, such as a police report or notarized affidavit. The refund rule takes effect January 1, 2027. The customer must report the transaction within 60 days.
