The law defines who controls a reinsurance intermediary and who counts as a manager of a reinsurer’s assumed reinsurance business. These definitions concern people who direct a reinsurance intermediary or manage some or all of a reinsurer’s assumed reinsurance business while acting for the reinsurer. The law excludes reinsurer employees, managers of U.S. branches of foreign reinsurers, and certain managers of insurer groups examined by their state regulator. An underwriting manager handling all of a reinsurer’s reinsurance operations is excluded only if the manager is under common control with the reinsurer, covered by the holding company law, and not paid based on premium volume. An underwriting manager handling facultative risks is excluded only if that business is less than 10 percent of the reinsurer’s assumed annual gross written premium. The act took effect July 1, 2026.
