Starting with plans issued or changed after December 31, 2026, health coverage must include HIV prevention medicines and related testing and counseling under these rules.
Covered plans provide medicines to prevent HIV before or after possible exposure, plus testing and counseling, without charges or approval steps for covered options. Exceptions apply to some plans, and people may face limits on which medicine versions are covered.
Covered plans provide medically necessary HIV prevention medicines and support services without cost sharing, prior authorization, step therapy, or unreasonable coverage delays. The rules cover individual, group, and blanket health insurance, the state health plan, and health benefit plans issued under Delaware law. Plans may limit coverage to some equivalent medicine versions, but must cover a version of both PrEP and PEP without charges or approval steps; different long-acting durations are not equivalent. If a treating provider recommends a particular medicine based on the person’s medical needs, the plan must cover it without charges or approval steps. For the state health plan, these protections apply only to the extent federal law allows. Certain high-deductible plans and limited-benefit policies have exceptions. The law applies to policies, contracts, and certificates issued, renewed, changed, amended, or reissued after December 31, 2026.
