For calculations sent on or after December 1, 2026, qualified Delaware employers’ workplace safety insurance credits will use a 40% formula.
Qualified employers’ insurance credits will use 40% of one minus a number tied to their prior rating. If they had no rating in the prior policy period, the Insurance Commissioner sets that number by rule. This applies to calculations sent on or after December 1, 2026.
The workplace safety credit formula uses 40% times one minus a number called C. It covers qualified employers in Delaware’s workplace safety program. C measures the employer’s credibility under the insurance rating plan for the policy period immediately before the credit. If the employer had no rating then, the Insurance Commissioner sets C by rule. Credits are rounded to the nearest whole percent. The formula applies to safety credit calculations the Department of Insurance communicates on or after December 1, 2026.
