If enacted, Delaware would bar cryptocurrency kiosks and store transactions designed to replace them when people buy or transfer cryptocurrency for government-issued money.
People could not own, install, or run cryptocurrency kiosks in Delaware. Kiosks already in place would have to stop operating when the measure takes effect and be removed within 90 days.
People could not help others buy or transfer cryptocurrency for government-issued money through store checkouts, cashier help, or similar kiosk substitutes. People controlling property could not knowingly allow kiosks or those transactions there.
People who break these rules could face court orders, penalties of up to $10,000, or lawsuits for harm. Fees from banned transactions would have to be refunded, or paid to a consumer fund if the payer cannot be identified.
People would be barred from owning, installing, or operating cryptocurrency kiosks. A kiosk is a machine run by a third party that customers use to buy, sell, or exchange cryptocurrency. Kiosk operation would stop when the measure takes effect. Kiosks in place before then would have to be removed within 90 days.
People would be barred from directly or indirectly helping others buy or transfer cryptocurrency for government-issued money through methods designed to replace a kiosk. The restriction covers store checkouts, cashier-assisted transactions, and similar methods designed to replace a kiosk. People who control a property could not knowingly allow a kiosk or a banned transaction there.
Violations would count as unlawful trade practices, and people collecting fees from banned transactions would have to return or redirect them. These rules cover violations of the kiosk restrictions, including kiosk substitutes and knowingly allowing banned activity on property under one's control. If the payer cannot be identified, the fees would go to the consumer protection fund. Failing to return or redirect the fees would be a separate violation. Fees would have to be refunded or paid to the fund within 30 days after collection.
