Delaware’s Auditor of Accounts receives the office’s criminal background-check records and may use them, as allowed by law, to assess employment or continued access to state resources.
The law names the Auditor of Accounts as the person who receives and may use the office’s criminal background-check information. The Auditor also makes written requests for checks.
The State Bureau of Identification must send the covered criminal background-check information to the Auditor of Accounts. The provisions govern background-check information for Delaware’s Office of Auditor of Accounts, including checks for current employees and contractors. The Auditor may review and use the records only as allowed by law, including to assess employment or continued access to state systems, facilities, or data. Covered contractors include current or prospective contractors whose work requires access to state agency systems, facilities, or data that the Auditor identifies as requiring a background check. Current employees and contractors must submit the required information within 30 days after receiving the Auditor’s written request for a background check.
