Starting October 1, 2026, kiosk vendors may use limited video in employee lounges, and everyone must consent before certain employment contract talks are overheard or recorded.
A vendor operating a self-service kiosk in an employee lounge may record the checkout and product display areas, but not sound. The vendor keeps the video, and employers generally cannot view or use it for discipline.
Employers, employees, and people acting for them must not intentionally overhear or record talks between the two sides about an employment contract unless everyone taking part agrees.
A third-party vendor operating a self-service kiosk in an employee lounge may use limited video surveillance. A self-service kiosk is a stand-alone terminal where people can scan and buy items themselves. The exception covers a third-party vendor operating one in an employee lounge. The system must not record sound or voice and may record only the checkout area and the area where products are displayed for sale. The vendor must keep sole custody of the video and may release it only when this section permits or the law requires. An employer may not ask to view or use the video for discipline, except when the vendor reports an alleged employee theft. This section takes effect October 1, 2026.
Employers, employees, and people acting for them must not intentionally overhear or record certain contract negotiations without everyone’s consent. The rule applies to an employer or employee and their agents or representatives. The rule covers conversations or discussions between the employer and employee about negotiating an employment contract. Everyone taking part must consent to the overhearing or recording. This section takes effect October 1, 2026.
No hearings or votes scheduled.
