Starting in 2028, eligible arenas could use up to two highway-visible advertising displays if local approval and required federal checks allow them.
Qualifying arenas could use up to two highway-visible advertising displays under local approval, including displays approved by 2032 that benefit the arena. The exemption starts in 2028.
Before certain new highway-visible arena displays can be placed, the state must find they will not reduce federal aid or conflict with federal rules or agreements.
A new display more than one mile from its arena must be at least 5,000 feet from a display for another arena. Existing-route displays are excluded.
Certain arena advertising displays would be exempt from most state outdoor-advertising rules beginning January 1, 2028. The exemption covers qualifying displays at or promoting eligible arenas, including highway-visible displays bearing the arena’s name or logo. The arena must have at least 15,000 seats, be able to host professional sports permanently, and be fully built or under construction by January 1, 2027. Displays must advertise only products, goods, or services sold or promoted at the arena; tobacco, firearm, and sexually explicit advertising is barred. Local approval must set rules for sign numbers, sizes, spacing, lighting, and operating hours. The arena may have no more than two displays under the existing and new highway-visible exemptions. The section becomes operative January 1, 2028. The new highway-visible displays must have local approval by January 1, 2032.
The state must check new highway-visible displays for federal conflicts before they are placed. This applies to qualifying displays approved after January 1, 2027, under the new arena exemption. This applies to a new highway-visible display approved after January 1, 2027, under the approval route for displays authorized by January 1, 2032. If the state transportation department cannot make the determination, it must ask the Federal Highway Administration. The display may be placed only after that agency makes the required finding. The check applies before placement of a display approved after January 1, 2027.
Certain new displays far from an arena must keep a minimum distance from displays for other arenas. The spacing rule concerns displays for different arenas authorized under the arena exemption. The rule applies only to a display approved after January 1, 2027, under the new approval route and located more than one mile from its arena. It does not apply to displays authorized under the existing route tied to approval as of January 1, 2021. The rule applies to displays approved after January 1, 2027.
