Social media platforms grossing over $100 million yearly would owe damages for carelessly injuring children until 2035

1
What it does
Until 2035, social media platforms grossing over $100 million yearly would owe the larger of $5,000 per violation, capped at $1 million per child, or triple actual damages for carelessly injuring a child under 18. Cases pending on or before January 1, 2027, are excluded.
Argument forUntil 2035, the damages formula could give children under 18 more than their actual damages when a platform grossing over $100 million yearly carelessly injures them. Cases pending on or before January 1, 2027, are excluded.
Argument againstUntil 2035, platforms grossing over $100 million yearly could owe $5,000 per violation for carelessly injuring a child under 18, even when actual damages are small. Cases pending on or before January 1, 2027, are excluded.
More detail
A social media platform grossing over $100 million yearly would owe the larger of $5,000 per violation, capped at $1 million per child, or triple the child's actual damages for carelessly injuring a child under 18. This covers children under 18 and social media platforms with more than $100 million in yearly gross revenue. The platform must fail to use ordinary care and cause the child's injury. A waiver of this damages rule would have no legal effect. The rule applies only going forward. It does not cover cases pending on or before January 1, 2027, and ends January 1, 2035.
