Foster youth 14 and older could access relevant school records
School districts would let foster youth age 14 or older see records relevant to their education without written parental consent or a court order.
1
What it does
School districts would have to let foster youth age 14 or older review their own records when those records relate to their education. They would not need a parent’s written consent.
If a state panel finds this law requires school districts or local agencies to spend money, the state would repay those costs under existing rules.
Argument forAccess could help older foster youth review records relevant to their education without waiting for a parent’s written consent.
Argument againstSchool districts may need more staff time to handle requests and decide which records are relevant to each foster youth’s education.
More detail
School districts would have to let eligible foster youth see relevant school records. This applies to foster youth age 14 or older seeking their own school records. Access covers only records relevant to the youth’s education. Written parental consent and a court order are not required for access under this exception.
The state would reimburse school districts and local agencies for qualifying costs. This covers costs the law requires school districts and local agencies to bear. The Commission on State Mandates must first decide that the law requires those costs. Repayment would follow existing state procedures.
