The law adds an exception to the usual meal rules for certain building maintenance workers covered by an agreement that meets specific meal and pay requirements.
Building maintenance workers who meet the law’s definition of stationary engineer may follow meal periods in a qualifying labor agreement instead of the usual state rules. The agreement must provide meal periods and meet pay and other requirements.
The usual state meal-period rules do not apply when a qualifying labor agreement provides for meal periods. This covers building maintenance workers who operate, maintain, monitor, or repair stationary equipment and building systems in a fixed facility. Their occupation must have a state-registered apprenticeship program established on or before December 31, 1964, that includes “Stationary Engineer” in its name. The agreement must cover wages, work hours, and working conditions; provide meal periods; require final and binding arbitration of meal-period disputes; provide premium pay for all overtime hours; and set regular hourly pay at least 30 percent above the state minimum wage. The text gives no separate start date for this change.
