Claimants must declare claims against public agencies are true
People filing claims against California public entities or employees must declare that the claim is true based on their information and belief.
1
What it does
People making claims against public entities or employees must sign a statement saying the claim is true to the best of their information and belief. A business invoice may be used without a signature for claims involving supplies, materials, equipment, or services.
Argument forRequiring a truth declaration may encourage people to check their claims before sending them to a public agency.
Argument againstPeople filing a claim may find the added truth declaration harder if they cannot yet confirm every detail.
More detail
A claimant, or someone acting for them, must sign the claim and declare that its contents are true and correct based on what they know and believe. This applies to claims against a public entity or public employee. Claims for supplies, materials, equipment, or services may use a regularly used business billhead or invoice without a signature.
