California vehicle sharing programs would have to cover third-party injuries and damage at higher minimum amounts, except when an owner helps a driver keep a vehicle past its return deadline.
Sharing programs must cover third-party injuries and property damage during a vehicle share, up to the amounts in their agreements and at least $250,000 for one person's injury or death, $500,000 for all people's injuries or deaths, and $100,000 for property damage.
Personal vehicle sharing programs must take on the vehicle owner's liability for third-party injuries or property damage during sharing. This applies to losses during a personal vehicle sharing period when someone other than the owner operates or controls the vehicle, or the program otherwise controls it. It covers injury or property damage to third parties. The program agreement sets the amounts, which must meet the stated minimums. This rule does not apply if the owner acts together with a shared vehicle driver who fails to return the vehicle as agreed. The coverage applies during the sharing period when the vehicle is operated or controlled by someone other than its owner, or is otherwise controlled by the program.
