California would send unclaimed vehicle sale proceeds to the Controller
Starting January 1, 2030, people could file claims for lien sale proceeds after three years, while the DMV must transfer remaining funds to the Controller.
1
What it does
People claiming an interest in a vehicle could still seek lien sale proceeds after three years. The DMV must send any funds left in the account at that point to the Controller as unclaimed property.
Argument forPeople who miss the three-year filing deadline could still seek money they are owed, since the bill removes that cutoff for DMV claims.
Argument againstClaimants may face an extra step to recover money after it moves from the Motor Vehicle Account to the Controller as unclaimed property.
More detail
The Department of Motor Vehicles must send remaining lien sale proceeds to the Controller as unclaimed property. This covers lien sale proceeds forwarded to the DMV and deposited in the Motor Vehicle Account, unless federal law requires a different use of the funds. A person may claim an interest in the vehicle, but the DMV must determine that the person is entitled to payment. The transfer covers funds still in the Motor Vehicle Account three years after deposit. The change would take effect January 1, 2030. The DMV must transfer remaining funds three years after they are deposited in the Motor Vehicle Account.
