Starting January 1, 2027, districts entering transfer agreements must post clear request policies, and families may ask both districts to review a transfer at once.
For agreements entered on or after January 1, 2027, school boards must post transfer policies covering deadlines, approval rules, appeals, and when a permit may be canceled. The rules also set decision deadlines and limited extensions.
School districts entering a new interdistrict agreement must include the required transfer policy provisions in that agreement.
When districts have an agreement, families may send a transfer request to both at once, and the proposed district must start reviewing it when it arrives.
School boards must adopt and post a policy explaining how families can request an interdistrict transfer. This applies to school districts that have an interdistrict attendance agreement. The policy must cover request timelines, approval criteria, appeals, and the conditions for canceling an existing permit. For current-year requests, districts generally must give a final decision within 30 days. If a request is incomplete, the district must identify missing information within 30 days and may extend review by up to 30 more days with timely written notice. A pending or scheduled individualized education program meeting also allows an extension of up to 30 days with timely written notice. For requests for a future school year, districts must decide as soon as possible and no later than 14 days after instruction begins. The new agreement requirements apply to agreements entered on or after January 1, 2027. Conflicting rules in older agreements continue until those agreements expire or are renewed.
New interdistrict agreements must include the required transfer policy provisions. This applies to agreements between school districts for students to attend school outside their district of residence. The required provisions are those listed in the district’s transfer policy, including procedures and timelines for requests. This applies to agreements entered on or after January 1, 2027. Conflicting terms in agreements made earlier continue until the agreement expires or is renewed.
A parent or guardian may send a transfer request to both districts at the same time, and the receiving district must start its review when it gets the request. This applies when the student’s home district and proposed district have an interdistrict attendance agreement. The receiving district must start reviewing the request regardless of whether the district where the student lives has responded. The proposed district begins review upon receiving the request; the home district’s response does not have to come first.
