Beginning in 2028, qualifying older collector vehicles would gradually stop needing smog certificates for registration, renewals, and ownership transfers.
Vehicles at least 35 model years old could qualify as collector motor vehicles if owners prove collector insurance or limited annual driving, while meeting use restrictions.
Qualifying collector vehicles would gradually stop needing smog certificates for registration, renewal, and ownership transfers, beginning with vehicles made before 1981 in 2028 and reaching pre-1986 vehicles in 2033.
The bill expands which vehicles qualify as collector motor vehicles. The expanded category covers vehicles at least 35 model years old that either have collector insurance with proof submitted to the Bureau of Automotive Repair or are shown through a bureau process to be driven fewer than 1,000 miles per calendar year. The vehicle must mainly be used for shows, parades, charitable events, historical exhibitions, display, maintenance, or preservation. The vehicle cannot be used mainly as the owner's regular transportation.
Certain collector motor vehicles would not need smog certificates for initial registration, renewal, or ownership transfers. The exemption covers qualifying collector vehicles made before the 1981 model year beginning in 2028, with the cutoff moving forward one model year each year until vehicles made before the 1986 model year qualify beginning in 2033. The Bureau of Automotive Repair must adopt regulations, forms, procedures, and other requirements to implement the exemption. Starting in 2028, the vehicle must meet the collector-use rules and have collector insurance with proof submitted to the bureau. Starting in 2030, vehicles qualifying through the under-1,000-miles-per-year standard may qualify only under the model-year cutoffs beginning with vehicles made before the 1983 model year. The bureau may charge administrative fees, capped at twice the annual smog abatement fee. The phased exemption begins January 1, 2028, and reaches vehicles made before the 1986 model year on and after January 1, 2033.
