Beginning June 30, 2027, people selling timeshares would follow dedicated licensing and training rules, with a possible 30-day certificate for qualified applicants.
People who sell or exchange timeshares would use a dedicated license and work under a licensed real estate broker. The license would focus on timeshare rules and practices.
A qualified applicant could receive one 30-day certificate without taking the exam first. The developer’s designated broker must certify that training will come before any offer or sale.
Real estate licensees could also handle timeshare sales within the licensing system. Timeshare salespeople would still need the required license or allowed short-term certificate.
The real estate department would license people who sell or exchange timeshare interests under a real estate broker’s supervision. This covers individuals who sell or exchange timeshare properties for a timeshare developer or another person. Applicants must meet the chapter’s licensing requirements. The commissioner may set rules for preparation courses and must test applicants on timeshare-related laws, practices, ownership, contracts, liens, foreclosure, and ethics. Sales must remain under the supervision and review of a licensed real estate broker. These provisions apply on and after June 30, 2027.
The commissioner may issue a one-time 30-day certificate allowing a timeshare salesperson to work without first taking the examination. This applies to a person who has applied for and otherwise qualifies for a timeshare salesperson license. The designated broker for the employing timeshare developer must certify that the applicant will receive training in applicable timeshare and contract laws before making an offer or sale. The certificate does not remove other licensing requirements unless the statute specifically allows it. The certificate may last for 30 days and applies on and after June 30, 2027.
A person licensed as a real estate broker or salesperson may engage in timeshare sales without a separate license for each other sales category. A real estate licensee may have only one employing broker in the timeshare licensing category, and a designated or employing broker may employ timeshare salespeople under the stated licensing structure. Timeshare salespeople must hold the required license unless the certificate provision applies. People and businesses may not perform covered licensed activities without meeting the chapter’s licensing and compliance requirements. These rules apply on and after June 30, 2027.
