Health and human services agencies could discipline a facility over violations that pose no risk to patients or residents only after giving it 72 hours to fix them.
An agency could take disciplinary or enforcement action against a facility for an administrative deficiency only after giving the facility 72 hours to fix it. This applies to facilities that the Department of Health Services, the Arizona Health Care Cost Containment System, or the Department of Economic Security licenses or contracts with. An administrative deficiency is a violation that does not affect a patient or resident physically or psychosocially and has no potential to harm them that way. The 72-hour rule applies when only administrative deficiencies are found. The facility gets 72 hours to fix the problem before the agency acts.
