A county attorney may establish a diversion program for a defendant who is a military member or veteran. The program may cover current or former members of the U.S. Army, Navy, Air Force, Space Force, Marine Corps, or Coast Guard, including reserve and National Guard members. The county attorney has sole discretion over whether to divert the prosecution. The program may require a guilty plea before entry. The program may allow dismissal of the criminal complaint after successful completion. Defendants charged with an offense involving death or serious physical injury, certain offenses under Title 13, chapters 14 or 35.1, or a continuing criminal enterprise are not eligible.
