Starting January 1, 2030, authorized transporters handle covered mental health transfers, with peace officers allowed to transport only in specified cases.
For covered transfers, an authorized transporter handles apprehension and transport. A peace officer may transport the person only in listed cases, including incarceration, a safety need, or a request for emergency assistance.
An authorized transporter must handle covered apprehensions and transfers, except when a listed case allows a peace officer to transport the person. The rule applies to transfers from a hospital emergency department or a locked behavioral health unit to another health care institution, an evaluation agency, or a mental health treatment agency. A peace officer may transport the person if they are incarcerated, if there are reasonable grounds to believe they cannot be safely apprehended without officer help, or if someone requests an officer through 911 or a similar emergency number and needs emergency assistance. The rule takes effect January 1, 2030.
No hearings or votes scheduled.
