Arizona cities, counties, and the state could not require digital driver licenses, and the state would offer non-REAL ID licenses to residents who are lawfully in the United States.
Cities, towns, counties, and the state could not require anyone to use a digital or mobile driver license or ID. They would have to accept a physical license for all identification purposes.
The state would keep offering driver licenses and ID cards that do not meet REAL ID rules, marked as such, to Arizona residents lawfully in the U.S. Applicants must be told REAL ID is voluntary.
The department could not keep copies of the documents people use to prove who they are, and could not share their information with interstate or federal databases, except in two narrow cases.
If federal REAL ID law is repealed or changed in certain ways, the department would immediately stop issuing REAL ID-compliant licenses and end its REAL ID compliance measures.
Cities, towns, counties, and the state would not be allowed to require a digital or mobile driver license or ID. This covers any government service or purpose in Arizona. A physical driver license or nonoperating ID card must be accepted for all identification purposes in the state.
The Department of Transportation would offer licenses and ID cards that are not REAL ID-compliant and tell every applicant they may choose either type. Only people whose home state is Arizona and whose presence in the United States is authorized under federal law could get a non-REAL ID license or ID. These licenses and IDs must be marked "not for real id act purposes." The department must tell applicants both out loud and in writing, and public materials about REAL ID must say it is voluntary. Applicants must get a list of the forms of ID that the Transportation Security Administration currently accepts.
The department would not keep copies of identity documents and would keep applicants' information out of interstate, federal, and international databases. This applies to people who get a non-REAL ID driver license or nonoperating ID card. The department may keep copies when federal law requires them to issue a commercial driver license. Information may be shared for valid purposes of the national law enforcement telecommunications system. Information may be shared for the driving-record check federal rules require before issuing a commercial driver license.
The state would repeal section 28-3175, and the department would immediately end its REAL ID compliance steps and stop issuing REAL ID-compliant licenses. This applies to the Department of Transportation and to people who would otherwise get REAL ID-compliant licenses or IDs. This happens only if federal REAL ID law is repealed, the federal definition of "official purpose" changes, or federal laws or rules are changed to prohibit state issuance of non-REAL ID-compliant licenses. The department must notify the director of the Arizona Legislative Council in writing of the date. It would take effect as of the date any one of these federal events occurs.
