What it does
If signed, Alaska lawmakers could appropriate up to 25 percent of the court system's prior-year filing fees to a fund that supports legal services for qualifying low-income people. Annual funding would still depend on legislative action.
Argument forThe fund could help qualifying low-income people obtain civil legal services if lawmakers make the allowed appropriations.
Argument againstBecause the fund is not dedicated and lawmakers may choose whether to appropriate money, organizations may not receive dependable annual funding.
More detail
Alaska lawmakers may appropriate money to the civil legal services fund. The fund may support organizations that provide civil legal services to people whose income is no more than 125 percent of Alaska's federal poverty guidelines. Annual deposits may come from money received under AS 09.17.020(j) and from the general fund, subject to the stated limit. The general-fund amount may be up to 25 percent of filing fees the Alaska Court System received during the previous closed fiscal year. The fund is not a dedicated fund, so this text does not guarantee that money will be set aside or spent. The amount based on court filing fees uses fees received during the previous closed fiscal year; no other start or end date is stated.
