Eligible organizations outside the insurance industry may buy credits left unsold after insurers apply. They may pass each credit to an eligible Colorado insurer only once.
The law allows eligible organizations outside the insurance industry to buy unsold insurance tax credits. Buyers must be authorized to do business in Colorado and contract with the Department of the Treasury to purchase credits. A receiving insurer must be authorized to do business in Colorado and owe premium tax. The credits must remain unsold after the Department of the Treasury's application process for insurance companies. A buyer may transfer a purchased credit once, and only to a Colorado-authorized insurance company with premium tax liability. That insurer may transfer it only under the rules for certain business changes or another specified transfer rule.
