Public employees serving in specified military forces receive leave without losing pay or listed benefits for qualifying service, up to four weeks of their regular work schedule.
The law provides qualifying military service leave without loss of pay or listed benefits, up to four weeks of an employee’s regular work schedule. This covers state and local public employees who serve in the National Guard, another state military force, or a United States reserve force. The service must be training or active service ordered or authorized by proper authority under law. The employer must allow leave if the service is satisfactorily performed; satisfactory performance is presumed unless the contrary is established. The four-week limit applies in the leave year set by the employer. The law takes effect July 1, 2026.
