When a vacancy leaves a district agricultural association board without a quorum for 90 days, the board may appoint a temporary director while awaiting the Governor’s appointment.
If the Governor has not filled a board vacancy within 90 days and too few directors remain for a quorum, the board may appoint a temporary director.
The Governor may later appoint a different director to serve the rest of the vacant term, at which point the temporary director leaves the board.
The board may temporarily appoint a director to fill a vacancy and establish a quorum. This applies when a vacancy leaves the board with too few members to establish a quorum. The board must follow the state open-meeting law when making the appointment. The temporary director must meet the eligibility requirements that apply under this chapter. The board may make the temporary appointment after the vacancy has remained unfilled for 90 days, if the board lacks a quorum.
The Governor may appoint a different director to serve the rest of the vacant term, replacing the temporary director. This applies to a vacancy temporarily filled by the board. The temporary director leaves the board when the Governor appoints a different director to serve the unexpired term.
